Momentous changes initiated in 2021 will continue to influence policy development and rulemakings in 2022. Administration appointments in political leadership positions have been filled. New policies and priorities have been unveiled, and with Democrats in control, a more encouraging attitude toward regulation and regulatory initiatives has taken root.

Notwithstanding the emphasis declared by the White House about the issues of climate change and environmental justice for the U.S. Environmental Protection Agency (EPA), the Administration will continue to be challenged in having to address many other competing priorities. For EPA’s Office of Chemical Safety and Pollution Prevention (OCSPP), emphasis on science integrity, reviewing decisions made by the Trump Administration in both the pesticide and industrial chemicals programs, meeting statutory deadlines looming over the work of both programs, and dealing with the constant problem of EPA-wide competing priorities will drive the OCSPP program budget and regulatory priorities.

Infrastructure Bill Includes Provisions Important to Chemical and Agriculture Sectors

On November 8, 2021, the Infrastructure Investment and Jobs Act (H.R. 3684) was presented to President Joseph Biden (D) for signature. The House passed the bill on November 5, 2021, by a vote of 228 to 206, and the Senate passed the bill on August 10, 2021, by a vote of 69 to 30. The bill contains many important provisions.  When it comes to per- and polyfluoroalkyl substances (PFAS), the U.S. Environmental Protection Agency (EPA) is not messing around. The agency announced on June 10, 2021, three actions intended to protect communities from PFAS:

• proposing a rule designed to obtain comprehensive data on more than 1,000 PFAS manufactured in the United States;
• withdrawing guidance that EPA believes weakened its July 2020 significant new use rule (SNUR) restricting certain long-chain PFAS; and
• publishing a final rule that incorporates three additional PFAS into the Toxics Release Inventory (TRI) maintained under the Emergency Planning and Community Right-to-Know Act (EPCRA).

More information about these rules is available in our June 11, 2021, memorandum “EPA Announces Three PFAS Actions, Including Proposed TSCA Section 8(a) Reporting Rule.” Comments on these proposed rules are due on or before September 27, 2021.

The proposed rule intended to obtain comprehensive data on PFAS would require all manufacturers (including importers) of PFAS in any year since 2011 to report information related to chemical identity, categories of use, volumes manufactured and processed, byproducts, environmental and health effects, worker exposure, and disposal. As a result of these EPA regulatory actions, companies that never expected to need to know TSCA are now finding themselves in EPA’s crosshairs.
