The National Nanotechnology Coordination Office (NNCO), on behalf of the U.S. Government’s National Nanotechnology Initiative (NNI), invites you to participate in a public meeting to discuss the revision of the NNI’s 2011 Environmental, Health, and Safety (EHS) Research Strategy. Individuals, non-governmental organizations, academic and research institutions, and the private sector interested in the responsible development of nanotechnology are encouraged to attend and contribute to creating an updated EHS Research Strategy.

The NNI seeks feedback and perspectives on progress toward the goals set out in the NNI’s 2011 EHS Research Strategy and on remaining research gaps, new challenges, and opportunities. By involving the broadest cross section of stakeholders early in the process, the NNI hopes to prepare a fresh and durable strategic guide that is responsive to the continuing evolution of nanotechnology as an enabling technology.

Dr. Engler is a 17-year veteran of EPA and is one of the most widely recognized experts in the field of green chemistry, having served as senior staff scientist in EPA’s OPPT and leader of EPA’s Green Chemistry Program. He has participated in thousands of TSCA substance reviews at EPA, and pre-notice and post-review meetings with submitters to resolve complex cases.

Lynn L. Bergeson, Managing Partner, B&C, counsels corporations, trade associations, and business consortia on a wide range of issues pertaining to chemical hazard, exposure and risk assessment, risk communication, minimizing legal liability, and evolving regulatory and policy matters pertinent to conventional, biobased, and nanoscale chemicals, particularly with respect to TSCA, the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and analog global chemical product programs. I had the opportunity on April 20th 1970 to be an active participant in the celebration of America’s first Earth Day. Time flies. I cannot believe it has been 53 years! Earth Day 1970 was held 8 months before the creation of the Environmental Protection Agency (EPA). We, at the NanoBusiness Commercialization Association (NanoBCA), have been discussing our environment since our first conference in 2002. We continue to have discussions in regard to the EPA on our monthly webinars.

EPA Opens Registration for Part Two of Its Webinar Series on Reviewing MMOs

The U.S. Environmental Protection Agency (EPA) has opened registration for the second of its two-part webinar series on EPA’s new standardized process to assess risk and apply mitigation measures, as appropriate, for mixed metal oxides (MMO), including new and modified cathode active materials (CAM). The webinar, which will be held March 30, 2023, will give an in-depth look into the standardized risk assessment approach and present various case scenarios and a decision tree for identifying potential hazards and risks. The kickoff webinar, held in November 2022, provided a broad overview of the approach and answered stakeholder questions. A summary of the first webinar is available in our November 23, 2022, memorandum.

The March 2023 issue of the National Institute for Occupational Safety and Health’s (NIOSH) eNews includes an item announcing publication of an article entitled “Results of the 2019 Survey of Engineered Nanomaterial Occupational Health and Safety Practices” in the International Journal of Environmental Research and Public Health. According to the abstract, the survey aimed to understand whether workers follow the recommendations of NIOSH’s Nanotechnology Research Center (NTRC). From September to December 2019, NIOSH worked with RTI International to administer an online survey about workplace safety and health practices related to nanomaterials. The abstract states that 45 U.S. and Canadian companies completed the survey developed by RAND Corporation. More than a third (37.8 percent) of the respondents reported using at least one NIOSH resource to acquire information about safe handling of engineered nanomaterials. The abstract notes that the small number of companies that responded to and completed the survey “is a considerable limitation to this study.” The abstract states that the survey data “are valuable for gauging the reach and influence of the NIOSH NTRC on nano OHS and for informing future outreach, particularly to small businesses.”

NNI Publishes Supplement to the President’s 2023 Budget Request

Lynn L. Bergeson, Managing Partner, Bergeson & Campbell, P.C and Carla N. Hutton, Regulatory Analyst, Bergeson & Campbell, P.C have provided the highlights of the 84-page NNI Supplement to the President’s 2023 Budget Request.

On February 3, 2023, the National Nanotechnology Initiative (NNI) announced that it published a supplement to President Biden’s 2023 budget request. NNI notes that the supplement serves as its annual report, called for under the provisions of the 21st Century Nanotechnology Research and Development Act, and also addresses the requirement for Department of Defense (DOD) reporting on its nanotechnology investments. The NNI budget represents the sum of the nanotechnology-related investments allocated by each of the participating agencies. Each agency determines its budget for nanotechnology research and development (R&D) in coordination with the Office of Management and Budget (OMB), the White House Office of Science and Technology Policy (OSTP), and Congress. According to the supplement, the NNI agencies collaborate closely — facilitated through the Nanoscale Science, Engineering, and Technology (NSET) Subcommittee of the National Science and Technology Council (NSTC); its working group, communities of interest, coordinators, and strategic liaisons; and the National Nanotechnology Coordination Office (NNCO) — to create an integrated R&D program that leverages and amplifies resources and efforts to advance NNI goals and meet individual agency mission needs and objectives. NNI agencies support significant investments in research infrastructure, developing new research tools, and making these tools available through user facilities. The NNI also supports science, technology, engineering, and mathematics (STEM) education to prepare the workforce of the future.

The supplement states that the President’s 2023 budget supports nanoscale science, engineering, and technology R&D at 11 agencies. The five federal organizations with the largest proposed 2023 investments (representing 96 percent of the NNI total) are:

  • Department of Health and Human Services (HHS)/National Institutes of Health (NIH) (nanotechnology-based biomedical research at the intersection of life and physical sciences);
  • National Science Foundation (NSF) (fundamental research and education across all disciplines of science and engineering);
  • Department of Energy (DOE) (fundamental and applied research providing a basis for new and improved energy technologies);
  • DOD (science and engineering research advancing defense and dual-use capabilities); and
  • Department of Commerce (DOC)/National Institute of Standards and Technology (NIST) (fundamental research and development of measurement and fabrication tools, analytical methodologies, metrology, and standards for nanotechnology).

The supplement states that the proposed 2023 NNI investments “are synergistic with efforts to renew U.S. leadership in the semiconductor and microelectronics industries funded and authorized under” the Creating Helpful Incentives to Produce Semiconductors (CHIPS) and Science Act of 2022. Foundational nanotechnology research and nanoelectronic devices and systems will provide leapfrog capabilities in microelectronics. Research centers and user facilities supported by the NNI participating agencies DOE, DOD, NSF, and NIST include an extensive network of cleanrooms and other nanofabrication and characterization capabilities that are a strong foundation for the additional microelectronics infrastructure to be developed with CHIPS Act funding. NSF will build on its existing nanoscience and engineering education programs to develop the semiconductor workforce and education activities funded under the CHIPS Act.

This webinar offers our best-informed judgment as to the trends and key developments chemical industry stakeholders can expect in 2023. At a political level, the Republicans’ narrow control of the U.S. House of Representatives will almost certainly invite a greater degree of oversight of U.S. Environmental Protection Agency (EPA) actions, particularly with respect to implementation of the 2016 amendments of the Toxic Substances Control Act (TSCA). Concepts core to the Act, including “reasonably foreseen,” “to the extent necessary,” “systematic review,” and “best available science,” continue to evolve and not always in predictable, coherent, and consistent ways. Similar policy shifts are seen in the agricultural and biocidal area, with perhaps less dramatic effect. How the 2024 general election will influence EPA’s policy choices is unclear. In that the election cycle has already begun, we caution all to buckle up and prepare for what we expect will be an eventful, fascinating year.
